Timber trespass is when a landowner discovers their timber has been stolen or inadvertently harvested.


Timber trespass - you may be entitled to 3 times the value

According to the Timber Trespass Law (civil law KRS 364.130), a landowner can sue for triple compensation of stumpage value and damages if contact was not made in writing seven days prior to when the adjacent harvest started.  If contact was made and harvest boundaries were objected to, the landowner may still sue for triple compensation.  Please visit the Kentucky's Division of Forestry website for more information regarding timber trespass.
